These Terms of Service ("Terms") govern your use of the website zonmawebtech.com and the digital marketing, web development, and related services provided by Zonma Web Tech ("we", "us", "our"), a premier digital marketing and web development agency based in Faridabad, Haryana, India.

By accessing our website, submitting an inquiry, or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

Acceptance of Terms

By using our website or services, you confirm that:

• You are at least 18 years of age or have parental/guardian consent
• You have the legal authority to enter into this agreement on behalf of yourself or your organization
• All information you provide to us is accurate and complete
• You will comply with all applicable laws and regulations

We reserve the right to update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.

Our Services

Zonma Web Tech provides the following services:

• Search Engine Optimization (SEO)
• Website Design & Development (WordPress, Shopify, WooCommerce)
• Social Media Marketing (Instagram, Facebook, LinkedIn)
• Pay-Per-Click Advertising (Google Ads, Meta Ads)
• Graphic Design & Branding
• E-Commerce Development & Management
• Business Consultation

The scope, deliverables, timeline, and pricing of each project are agreed upon separately through a proposal or service agreement before work commences. These Terms apply in addition to any such project-specific agreements.

We reserve the right to refuse service to anyone for any reason at our sole discretion.

Client Obligations

As a client, you agree to:

• Provide accurate, complete, and timely information required for project execution
• Respond to communications within a reasonable timeframe (typically 3-5 business days)
• Provide necessary access to accounts, platforms, and tools as required (website, social media, ad accounts, etc.)
• Review and approve deliverables in a timely manner
• Not engage in any illegal, unethical, or prohibited activities using our services
• Not request work that infringes on third-party intellectual property rights
• Ensure all content provided to us (images, text, logos) is owned by you or properly licensed

Project delays caused by late client feedback or missing information may affect timelines and are not the responsibility of Zonma Web Tech.

Payment Terms

Payment terms are as follows:

• Project work: Typically 50% advance before work begins, 50% upon completion unless otherwise agreed
• Monthly retainer services: Payment due at the beginning of each month
• Ad spend: Client is responsible for all third-party ad spend (Google Ads, Meta Ads budgets) separately from our management fees
• Late payments: Invoices unpaid after 7 days may result in work being paused until payment is received
• Taxes: GST or other applicable taxes will be added as required by Indian law

All prices are quoted in Indian Rupees (INR) unless otherwise specified. Payment can be made via bank transfer, UPI, or other methods agreed upon at the time of engagement.

Intellectual Property

Client-owned content: Any content, logos, images, or materials you provide to us remain your property. By providing them, you grant us a license to use them solely for the purpose of delivering your project.

Deliverables: Upon full payment, ownership of the final deliverables (website, designs, content) transfers to you. Zonma Web Tech retains the right to showcase the work in our portfolio unless you request otherwise in writing.

Our tools & processes: Proprietary tools, templates, frameworks, and methodologies used in delivering your project remain the intellectual property of Zonma Web Tech and are not transferred to the client.

Third-party assets: Any third-party tools, plugins, stock images, or fonts used in your project are subject to their own licensing terms. Clients are responsible for maintaining appropriate licenses post-handover.

Confidentiality

Both parties agree to keep confidential any proprietary, sensitive, or non-public information shared during the course of the engagement. This includes but is not limited to:

• Business strategies and marketing plans
• Login credentials and account access
• Financial information and pricing
• Client data and customer lists

This confidentiality obligation survives the termination of the engagement. We will not disclose your confidential information to third parties without your written consent, except as required by law.

Limitation of Liability

Zonma Web Tech provides services on a best-effort basis. We do not guarantee specific results such as:

• Specific Google search rankings or positions
• A guaranteed number of leads, sales, or conversions
• Specific ROI from advertising campaigns
• Website traffic targets

Digital marketing results depend on many factors outside our control including search engine algorithm changes, market competition, and the client's own product/service quality.

To the maximum extent permitted by law, Zonma Web Tech's total liability to you for any claims arising from our services shall not exceed the total fees paid by you in the 3 months preceding the claim.

We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services.

Termination

By the client: You may terminate ongoing services with 30 days written notice. Any work completed up to the termination date will be invoiced and must be paid.

By Zonma Web Tech: We reserve the right to terminate services with 14 days notice if:

• Payment is overdue by more than 15 days
• The client engages in illegal, unethical, or abusive conduct
• The client requests work that violates our policies or applicable law
• The working relationship becomes untenable

Upon termination, we will provide you with all completed work and assets to which you are entitled based on payments made. Access to any accounts managed by us will be transferred back to you within 7 business days.

Revisions & Refunds

Revisions: The number of revision rounds included is specified in your project proposal. Additional revisions beyond the agreed scope may be charged at our standard hourly rate.

Refund policy:

• Advance payments are non-refundable once work has commenced
• If we are unable to begin work after receiving payment, a full refund will be issued
• Partial refunds may be considered on a case-by-case basis for work not yet completed
• No refunds are issued for completed and delivered work
• Monthly retainer fees are non-refundable once the service period has started

All refund requests must be submitted in writing to support@zonmawebtech.com within 7 days of the disputed transaction.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Faridabad, Haryana, India.

We encourage resolving disputes amicably first. If a dispute cannot be resolved informally within 30 days, it may be referred to arbitration under the Arbitration and Conciliation Act, 1996 of India.
